These Terms & Conditions (“Terms”) govern your access to and use of JerzeeUp.com (the “Website”), including purchases of products offered through the Website.

JerzeeUp (“JerzeeUp,” “we,” “us,” or “our”) is an online store operated by an individual sole proprietor in the State of Florida, United States.

By accessing the Website, creating an account, submitting an order, or purchasing a product, you agree to these Terms. If you do not agree, please do not use the Website or place an order.

1. ABOUT JERZEEUP

JerzeeUp is an online marketplace specializing in soccer jerseys, football apparel, collectibles and related merchandise.

Products offered through JerzeeUp may include, depending upon the individual listing:

  • New authentic merchandise;
  • Officially licensed merchandise;
  • Authentic pre-owned merchandise;
  • Authentic vintage merchandise;
  • Collectible jerseys;
  • Replica or reproduction merchandise;
  • Unlicensed replica merchandise, where expressly identified as such;
  • Customized jerseys and apparel; and
  • Other soccer-related merchandise.

Products may be owned or stocked by JerzeeUp, supplied by third-party vendors, or fulfilled directly to customers by domestic or international suppliers.

The status, condition, authenticity and characteristics of an item are determined by the description of the particular product being purchased.

2. AUTHENTICITY AND PRODUCT CLASSIFICATION

Because JerzeeUp offers different categories of merchandise, customers must review the individual product description before purchasing.

Products may be identified using classifications including:

Official Authentic / Licensed — Merchandise represented as authentic and/or officially licensed as stated in the applicable listing.

Authentic Pre-Owned — Genuine merchandise previously owned or used.

Authentic Vintage — Genuine merchandise from an earlier period or season, which may exhibit age, wear, manufacturing characteristics or other conditions consistent with its age.

Replica / Reproduction — A reproduction or replica product whose particular characteristics and status will be described in the listing.

Unlicensed Replica — A replica that is not represented by JerzeeUp as an officially licensed product of the referenced club, federation, manufacturer or other rights holder.

An item identified as a replica or unlicensed replica should not be interpreted as an authentic or officially licensed item unless the individual product listing expressly states otherwise.

The customer is responsible for reviewing the applicable classification before completing a purchase.

Nothing in these Terms constitutes a representation that the use of any third-party trademark on any particular product has been authorized by the trademark owner.

3. NO IMPLIED AFFILIATION

Unless expressly stated in a particular product listing, JerzeeUp does not represent that it is sponsored, endorsed, operated by, or officially affiliated with any soccer club, league, competition, federation, player, sportswear manufacturer or other third-party rights holder.

Names and references appearing on the Website may be used to identify or describe the products being offered.

Third-party trademarks, club crests, logos, player names and other intellectual property remain the property of their respective owners.

4. PRODUCT INFORMATION

We attempt to describe products accurately and provide useful photographs, measurements, sizing information, condition descriptions and other information.

However, colors may vary because of lighting, photography, manufacturing variations and display settings.

For vintage and second-hand merchandise, reasonable signs of age or previous use may exist. Material defects known to us should be disclosed in the listing when reasonably identifiable.

For replica merchandise, minor manufacturing differences may occur between production batches.

Customers should review photographs, descriptions, sizing information, authenticity classification and condition before ordering.

5. SIZING

Soccer jersey sizing may differ substantially between manufacturers, countries, seasons, player versions, fan versions and replica manufacturers.

A customer’s usual size in another brand or garment does not guarantee an identical fit.

Where measurements or a sizing chart are provided, customers should use them before ordering.

A product is not considered defective solely because the customer selected an incorrect size, provided the product materially corresponds to the sizing information supplied with the listing.

6. CUSTOMIZED PRODUCTS

JerzeeUp may offer customization including player names, customer-supplied names, numbers, badges, patches and other personalization.

The customer is responsible for verifying all customization information before submitting the order.

Customized or personalized products are generally FINAL SALE once customization or production has begun.

This restriction does not apply where the product:

  • Arrives materially damaged or defective;
  • Is materially different from what was ordered;
  • Contains an error in customization made by JerzeeUp or its fulfillment provider; or
  • Must otherwise be accepted for return or refunded under applicable law.

A spelling, number or other customization entered incorrectly by the customer is not considered a seller error.

7. ORDERS

Submitting an order does not automatically require JerzeeUp to accept it.

We reserve the right, subject to applicable law, to reject or cancel an order before fulfillment for legitimate reasons including:

  • Product unavailability;
  • Pricing or listing errors;
  • Suspected fraud;
  • Payment failure;
  • Inability to verify order information;
  • Shipping restrictions;
  • Supplier inability to fulfill the order;
  • Reasonable concerns regarding unauthorized resale or misuse; or
  • Legal or regulatory requirements.

If we cancel a paid order before shipment, the amount paid for the cancelled merchandise will be refunded as required by applicable law.

8. PRICES

Prices are displayed in the currency indicated on the Website.

Prices may change without notice, but a subsequent price change will not ordinarily alter the price of an already accepted order.

Typographical or obvious pricing errors may be corrected. If a material pricing error affects an order already submitted, we may contact the customer to offer the opportunity to purchase at the correct price or cancel the affected item for a refund.

Taxes, shipping, customs charges and other applicable charges may be calculated separately where appropriate.

9. PAYMENTS

Available payment methods are displayed during checkout.

Payment processing may be provided by independent third-party payment processors. JerzeeUp does not necessarily receive or retain the customer’s complete payment-card information.

By submitting payment information, the customer represents that they are authorized to use the selected payment method and authorizes the applicable charges associated with the order.

We may use reasonable fraud-prevention measures before fulfilling an order.

10. CANCELLATIONS

Customers should request cancellation as soon as possible by contacting:

We will attempt to accommodate cancellation requests, but cancellation cannot be guaranteed after an order has entered fulfillment, production, customization or shipment.

Nothing in this section eliminates cancellation or refund rights that cannot lawfully be waived.

11. DROPSHIPPING AND THIRD-PARTY FULFILLMENT

JerzeeUp uses third-party fulfillment and dropshipping arrangements for some merchandise.

Depending upon the item, an order may ship from:

  • The United States;
  • China; or
  • Another domestic or international fulfillment location.

Purchasing from JerzeeUp constitutes a transaction with JerzeeUp as identified through the Website and checkout; the fact that a third party physically stores, packages or ships merchandise does not by itself make that third party the customer’s retailer.

Orders containing multiple products may arrive in separate packages.

12. SHIPPING AND DELIVERY

Processing and shipping estimates displayed on the Website or product page are estimates unless expressly represented as guaranteed.

JerzeeUp will maintain a reasonable basis for shipment representations made to customers.

International fulfillment, customs processing, carrier disruptions, severe weather, holidays and other circumstances may affect transit times.

Where JerzeeUp cannot ship within a time promised to the customer, applicable cancellation, delay-notification and refund rights will be honored.

Detailed rules are contained in the JerzeeUp Shipping, Returns & Refunds Policy, which is incorporated into these Terms by reference.

13. INTERNATIONAL ORDERS

JerzeeUp may accept orders for delivery outside the United States.

International customers are responsible for providing accurate delivery information and complying with laws applicable to the importation of merchandise into their jurisdiction.

Depending upon the destination and shipping arrangement, customs duties, VAT, import taxes, brokerage charges or other governmental fees may apply.

Where such charges are designated as the customer’s responsibility during the transaction, they are not included in the product price unless expressly stated otherwise.

Customs authorities may inspect or delay international shipments.

14. RETURNS AND REFUNDS

Unless a different rule is clearly disclosed for a particular product, eligible merchandise may be requested for return within 15 days after delivery.

The product must satisfy the eligibility requirements contained in our Shipping, Returns & Refunds Policy.

Customized merchandise is generally final sale as described above.

Authentic vintage and second-hand products may have product-specific return conditions that are clearly disclosed before purchase.

Defective, damaged, materially misdescribed and incorrect merchandise will be handled in accordance with the applicable policy and law.

15. RETURN AUTHORIZATION

Customers should contact marketplace@jerzeeup.com before returning merchandise.

Do not automatically return merchandise to the address printed on the original shipping package.

Because products may originate from different fulfillment facilities, the appropriate return destination may differ from the shipment origin.

Sending a product to an unauthorized address may substantially delay processing.

16. CHARGEBACKS AND PAYMENT DISPUTES

Customers are encouraged to contact us promptly regarding an order problem so that we have an opportunity to investigate and resolve it.

Nothing in these Terms prevents a customer from exercising a lawful right to dispute a transaction with a card issuer, payment provider or financial institution.

JerzeeUp may contest chargebacks it reasonably believes are invalid and may provide the processor or financial institution with relevant transaction records, including order information, tracking, communications, delivery evidence and acceptance of these Terms.

Fraudulent payment disputes may result in account restrictions and other lawful remedies.

17. ACCOUNTS

Certain Website functions may permit or require an account.

Customers are responsible for maintaining the confidentiality of their login credentials and for activity occurring through their account to the extent permitted by law.

You agree to provide materially accurate information when creating an account or placing an order.

18. ACCEPTABLE USE

You may not use the Website to:

  • Commit fraud;
  • Attempt unauthorized access to systems or accounts;
  • Introduce malicious software;
  • Scrape or systematically extract protected Website content without authorization where prohibited by law;
  • Interfere with Website operation;
  • Impersonate another person;
  • Submit knowingly false payment information; or
  • Use the Website in violation of applicable law.

We may restrict access where reasonably necessary to protect the Website, customers or our legitimate interests.

19. JERZEEUP CONTENT

Except for third-party materials, the original Website design, text, photographs, graphics, organization, JerzeeUp branding and other original content created or owned by JerzeeUp are protected by applicable intellectual-property laws.

No transfer of ownership occurs merely because content is accessible through the Website.

20. THIRD-PARTY INTELLECTUAL PROPERTY

JerzeeUp respects intellectual-property rights.

If you are a rights holder or authorized representative and believe content or merchandise displayed on JerzeeUp infringes your intellectual-property rights, contact:

  2. The intellectual property claimed;

We may remove or restrict content or products while evaluating a legitimate complaint.

21. COPYRIGHT COMPLAINTS

Copyright owners may submit notices concerning allegedly infringing Website content to marketplace@jerzeeup.com.

Where the U.S. Digital Millennium Copyright Act applies, a notice should contain the information required by applicable law.

This procedure does not limit any rights or remedies available to intellectual-property owners.

22. THIRD-PARTY SERVICES

The Website may use services provided by payment processors, carriers, analytics providers, hosting providers, fulfillment providers and other third parties.

Third-party services may be governed by their own terms and privacy policies.

JerzeeUp is not responsible for independent third-party websites merely because the Website links to them.

23. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

WE DO NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE UNINTERRUPTED, ERROR-FREE OR FREE FROM EVERY SECURITY VULNERABILITY.

PRODUCT WARRANTIES, IF ANY, WILL BE THOSE EXPRESSLY PROVIDED WITH THE PARTICULAR PRODUCT OR REQUIRED BY LAW.

THIS SECTION DOES NOT EXCLUDE WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.

24. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JERZEEUP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE WEBSITE OR A TRANSACTION WITH JERZEEUP WHERE SUCH DAMAGES MAY LAWFULLY BE EXCLUDED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JERZEEUP’S AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO JERZEEUP FOR THE PRODUCT GIVING RISE TO THE CLAIM.

These limitations do not apply where liability cannot legally be limited or excluded.

25. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless JerzeeUp and its service providers from third-party claims arising directly from your unlawful use of the Website, your violation of these Terms, or content or customization material supplied by you that infringes another person’s rights.

This provision does not require a consumer to indemnify JerzeeUp for JerzeeUp’s own unlawful conduct.

26. GOVERNING LAW

Except where mandatory consumer-protection law provides otherwise, these Terms and transactions with JerzeeUp are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

Customers outside Florida may possess mandatory consumer rights under laws that cannot contractually be waived. Nothing in these Terms is intended to eliminate such rights.

27. DISPUTES

Before initiating formal proceedings, customers are encouraged to contact marketplace@jerzeeup.com and provide a reasonable opportunity for the parties to attempt to resolve the dispute informally.

Unless applicable law requires otherwise, disputes arising from these Terms or purchases through JerzeeUp may be brought in a court of competent jurisdiction in Florida.

Nothing in this provision prevents a consumer from exercising rights to bring a claim in another forum when applicable law gives the consumer a non-waivable right to do so.

28. CHILDREN

JerzeeUp is intended for general audiences but purchases must be made by persons legally capable of entering into the transaction or with authorization of a parent or legal guardian.

We do not knowingly solicit personal information directly from children in violation of applicable law.

29. PRIVACY

Our collection and use of personal information are governed by the JerzeeUp Privacy & Cookies Policy, which should be reviewed together with these Terms.

30. ACCESSIBILITY

JerzeeUp seeks to make its Website reasonably accessible to customers, including customers with disabilities.

31. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect operational, technological, legal or regulatory changes.

The “Last Updated” date identifies the most recent version.

Material changes will apply prospectively as required by applicable law. The Terms applicable to an order generally will be those presented in connection with the transaction when the order was placed, except where a subsequent change is required by law.

32. SEVERABILITY

If a provision of these Terms is determined to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary, where legally permissible, while the remaining provisions continue in effect.

33. ENTIRE AGREEMENT

These Terms, together with the Privacy & Cookies Policy, Shipping, Returns & Refunds Policy, applicable product listing and other terms expressly presented during checkout, constitute the agreement applicable to use of the Website and purchases from JerzeeUp.

Product-specific terms control over these general Terms where the product-specific terms clearly state a different rule.
